Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of https://crazymonkeys.ai and related waitlist or informational pages (the “Site”) operated by Phoenix Dataworks LLC (“Phoenix Dataworks,” “we,” “us,” or “our”) for the Crazy Monkeys product.

By using the Site or submitting your email to the waitlist, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. What Crazy Monkeys / this Site is (and is not)

The Site currently provides information about Crazy Monkeys and a waitlist / contact path for product updates and potential design-partner conversations.

Crazy Monkeys is not:

A licensed penetration-testing firm or private-investigator service;

A CPA firm, auditor, or issuer of SOC 2 or other compliance attestations;

A guarantee that your application is secure, free of defects, or “ship-ready” for any regulator, insurer, or customer.

Any future paid product, design-partner run, or preview testing against your systems will require a separate written agreement and your written authorization. Joining the waitlist alone does not create a paid services contract or authorize us to access your systems.

3. Eligibility and accounts

You must be able to form a binding contract and use the Site only for lawful business or professional purposes. If we later offer accounts, you are responsible for credentials you control and for activity under your account.

4. Waitlist and communications

By joining the waitlist or submitting a form, you ask us to contact you about Crazy Monkeys availability, product updates, and related design-partner or preview opportunities. You can ask to be removed by emailing bobby@crazymonkeys.ai. See the Privacy Policy for how we handle your information.

5. Acceptable use

You agree not to:

Probe, scan, or attack the Site without our prior written permission;

Attempt to gain unauthorized access to systems or data;

Submit unlawful, infringing, or misleading content;

Use the Site to send spam or malware;

Scrape the Site in a way that impairs service or violates law;

Misrepresent that Phoenix Dataworks or Crazy Monkeys audited, pen-tested, certified, or insured your products solely because you visited the Site or joined the waitlist.

6. Intellectual property

Site content, branding (including Crazy Monkeys), and materials are owned by Phoenix Dataworks or its licensors. You may view the Site for your internal evaluation. You may not copy, modify, or redistribute Site materials for commercial publication without our written permission, except for fair use or other rights that cannot be waived.

7. Third-party links

The Site may link to third-party sites. We do not control and are not responsible for those sites or their privacy practices.

8. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOENIX DATAWORKS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR WAITLIST.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR SITE ACCESS IN THE THREE MONTHS BEFORE THE CLAIM (WHICHEVER IS GREATER). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

10. Indemnity

You will defend and indemnify Phoenix Dataworks against claims arising from your misuse of the Site or your violation of these Terms, to the extent permitted by law.

11. Changes

We may update these Terms by posting a new version on the Site with an updated “Last updated” date. Continued use after changes means you accept the revised Terms. For material changes affecting paid services (when offered), we may provide additional notice.

12. Governing law

These Terms are governed by the laws of the State of Arizona, excluding conflict-of-law rules. Courts in Maricopa County, Arizona, have exclusive jurisdiction, except where prohibited by applicable consumer law.
